Spring Valley residents sue Huntington for not maintaining storm water control system

WAYNE -- Twenty-three Spring Valley residents are suing the City of Huntington after they claim it was negligent in maintaining a storm water control system.

Jennie Brooks; Mary Adkins; Walter Boyle and Vaughna Boyle; Jonathan Estep and Julie Estep; Roy Gwilliams and Betty Gwilliams; John Jones and Karen Jones; Donzie Kaylor; James Kuhn and Mindy Kuhn; Robert McCloud and Melissa McCloud; Don Napier; David Stamper; Bernie Thompson and Nancy Thompson; Thomas Wellman; and Grace Wells all own property in Spring Valley in Wayne County, just outside of Huntington's city limits, according to a complaint filed July 6 in Wayne Circuit Court.

The plaintiffs claim in 2010 a Wayne County jury concluded the city was negligent in maintaining the Krouts Creek storm water control system and was responsible for causing "hundreds of thousands of dollars in property damages to residents."

The city knew it had a duty to maintain the system in order to avoid flooding, but "knowingly, willfully and recklessly" refused to do so, according to the suit.

The plaintiffs claim Huntington's conduct has jeopardized their safety and security in their homes and has caused even more damage to their property.

The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are being represented by John W. Barrett and Jonathan R. Marshall.

The case has been assigned to Circuit Judge James H. Young.
