Anchor Tobacco says companies didn't pay for $360K in goods

CHARLESTON -- Anchor Tobacco Company is suing two companies and an individual after he claims they failed and refused to pay for more than $360,000 in goods and services.

Cal Corp., Inc., which is doing business as Tom's Supervalue; Montecal Corp., Inc., which is doing business as Tom's Food Fair; and Calvin J. Canterbury, who is the sole stockholder of Cal Corp. and Montecal Corp., were named as defendants in the suit.

Anchor Tobacco Company sold and delivered goods to Cal Corp. in the amount of $286,739.52, which it failed and refused to pay, according to a complaint filed July 1 in Kanawha Circuit Court.

The company claims it also sold and delivered goods to Montecal Corp. in the amount of $67,589.63, which it failed and refused to pay.

Since Canterbury was the sole stockholder of Cal Corp. and Montecal Corp., the accounts of those corporations with Anchor Tobacco Company are his responsibility, according to the suit.

Anchor Tobacco company is seeking judgment in the amount of $364,329.15 with pre- and post-judgment interest. It is being represented by James D. Kauffelt.

The case has been assigned to Circuit Judge James C. Stucky.
