CHARLESTON -- A Clarksburg woman is suing three consumer reporting agencies for allegedly preparing inaccurate credit reports.
Plaintiff Elizabeth Carter filed the lawsuit in the U.S. District Court for the Northern District of West Virginia on Aug. 4.
Defendants named in the suit are Equifax Information Services LLC, Trans Union LLC and Experian Information Solutions Inc.
According to the suit, Carter notified Equifax and disputed the inaccurate information. Equifax, she alleges, continued to report the inaccurate information. It also failed to provide Carter with her credit report on request.
Trans Union and Experian did the same, Carter alleges.
Carter's lawsuit, which seeks six claims for relief, alleges that all three companies negligently and willfully failed to comply with the requirements of the Fair Credit Reporting Act.
As a result of their failure to comply, she says she has suffered and continues to suffer actual damages, including economic loss, denial of credit, lost opportunity to receive credit, damage to reputation, invasion of privacy, emotional distress and interference with her "normal and usual activities."
Carter, who is represented by John W. Barrett and Rebecca Pomeroy of Charleston law firm Bailey & Glasser LLP, is seeking actual and punitive damages and attorney fees.
