Woman sues Hyundai, Joe Holland for defective vehicle

CHARLESTON -- A Kanawha County woman is suing Hyundai Motor America and Joe Holland Chevrolet after she claims a vehicle she purchased was defective.

On Dec. 11, 2009, Jill Miles entered into a motor vehicle purchase contract with the defendants for the purchase of a 2009 Hyundai, according to a complaint filed July 12 in Kanawha Circuit Court.

Miles claims after purchasing the vehicle, she discovered and experienced repeated non-conformities that substantially impaired the use, value and/or safety of the vehicle.

As a result, Miles returned the vehicle to the defendants for repair on at least five occasions, according to the suit.

Miles claims despite efforts to allow the defendants the opportunity to repair the vehicle, they failed to repair the vehicle as to bring it into conformity with its warranties.

The defendants failed and refused to provide a comparable replacement vehicle and to reimburse her, according to the suit.

Miles claims the defendants violated the West Virginia lemon law.

The defendants' acts in refusing or failing to repair the vehicle and bring it into conformity are violations of West Virginia Code, according to the suit.

Miles is seeking for the contract to be declared canceled and compensatory and punitive damages with pre- and post-judgment interest. She is being represented by David L. Grubb and Cameron S. McKinney

The case has been assigned to Circuit Judge Carrie Webster.
