CHARLESTON -- Denver's Depot is suing Secure US Incorporated after it claims a break-in was not handled properly.
The break-in and robbery occurred on Feb. 14, according to a complaint filed July 21 in Kanawha Circuit Court.
Denver's Depot claims the security system failed and/or the defendant failed to properly respond and make the necessary telephone calls to the plaintiff and to the Charleston Police Department.
As a result of the defendant's failure, the thief was able to escape without being detected and made off with a substantial sum of money, according to the suit.
Denver's Depot claims it paid a fee for the defendant to maintain and monitor the security system and any alarms, but on the day of the break-in, the defendant was negligent in properly monitoring the alarms.
The defendant also breached its contract with the plaintiff by failing to properly report that the plaintiff's alarm was triggered, according to the suit.
Denver's Depot is seeking compensatory damages. It is being represented by Michael J. Del Giudice.
The case has been assigned to Circuit Judge James C. Stucky.
