Man sues Milk Transportation for car accident injuries

WINFIELD -- A Scott Depot is suing Milk Transportation after he claims he was involved in a car accident that caused him injury.

Santo E. Benincasa, the driver of the vehicle, was also named as a defendant in the suit.

On Aug. 10, 2009, Benincasa was operating a 1997 freight liner tractor trailer owned by Milk Transportation when he struck a vehicle being driven by Robert A. Edwards, according to a complaint filed Aug. 9 in Putnam Circuit Court.

Edwards claims Benincasa negligently and carelessly failed to maintain control of his vehicle by crossing the lane of traffic and colliding with his vehicle.

As a result of the collision, Edwards sustained serious and permanent injuries to his face, head and back, requiring hospitalization and medical treatment, according to the suit.

Edwards claims Milk Transportation was negligent in allowing Benincasa to operate the vehicle.

The defendants' negligence caused Edwards' injuries, according to the suit.

Edwards is seeking compensatory damages. He is being represented by Jeremiah F. McCormick.

The case has been assigned to Circuit Judge Philip Stowers.
