CHARLESTON -- A Wyoming County man is suing the West Virginia Division of Natural Resources after he was injured on a hiking trail.
West Virginia Division of Natural Resources - Parks and Recreation and Twin Falls State Park were also named as defendants in the suit.
On July 10, 2009, Kevin D. Price was at Twin Falls State Park in Wyoming County when he attempted to negotiate the trail leading to the falls pool area of one of the two falls, when he fell on the train, according to a complaint filed July 8 in Kanawha Circuit Court.
Price claims despite the steep nature of the terrain and the extremely slick nature of the surface of the path, the defendants failed to provide safe methods by which park visitors may reach the highly publicized namesake of the park.
The defendants are negligent for not providing handrails, steps or other safety devices at the location and in that the trail system was unsafe, according to the suit.
Price is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Timothy P. Lupardus.
The case has been assigned to Circuit Judge James C. Stucky.
