CHARLESTON -- A Boone County woman is suing Capital One Bank after she claims it continued to call and harass her after she informed them she was being represented by counsel.
Carrie Beth Giles was indebted to the defendant in the amount of $3,600 and on Jan. 28, she retained an attorney, according to a complaint filed July 25 in Kanawha Circuit Court.
On Feb. 1, Giles claims she received a phone call from the defendant attempting to collect on her debt and she informed the defendant she was being represented by an attorney and gave them her attorney's contact information. She claims she also requested all further inquires be directed to the attorney.
Despite requesting the defendant talk with her attorney, the defendant continued to call Giles on at least 15 more occasions, according to the suit.
Giles claims the defendant's actions were made with the intent to annoy, abuse, oppress or threaten her, which violates West Virginia Code.
The defendant also attempted to collect a debt when it knew Giles had an attorney, which constituted unlawful acts and practices in violation of West Virginia Code, according to the suit.
Giles is seeking compensatory damages. She is being represented by Robin L. Godfrey.
The case has been assigned to Circuit Judge Louis H. Bloom.
