CHARLESTON -- A Boone County man is suing Toyota Motor Sales for a vehicle he claims was defective.
On Aug. 6, 2009, Mark Agosti purchased a 2009 Toyota Camry from the defendant for $26,619, according to a complaint filed Aug. 8 in Kanawha Circuit Court.
Agosti claims after purchasing the vehicle he began to experience repeated non-conformities with it that substantially impaired the use and market value of the vehicle.
After a reasonable number of attempts, the manufacturer did not conform the new motor vehicle to the warranty nor replace the vehicle with a comparable new motor vehicle, according to the suit.
Agosti claims the defendant's failure was a breach of contract.
Agosti is seeking revocation of acceptance of the vehicle, refund of the purchase price and compensatory damages. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Carrie Webster.
