CHARLESTON -- A former employee is suing Herbert J. Thomas Memorial Hospital Association after she claims her employment was wrongfully terminated because she complained about safety issues.
Diamond Healthcare Corporation was also named as a defendant in the suit.
Susan Nutter was employed by the defendants from August 2008 until Nov. 16, 2009, according to a complaint filed Aug. 11 in Kanawha Circuit Court.
Nutter claims during her employment she complained to the defendants regarding safety concerns and violations of law and insisted on following reasonable and lawfully required safety practices and protocols.
The defendants terminated Nutter's employment because of her complaints, according to the suit.
Nutter claims the defendants filed a false complaint against her with the Nurse Licensure Board in an attempt to restrain her ability to earn income as a nurse and damaged her reputation.
The defendants' actions were intentional and/or reckless and were outrageous, according to the suit.
Nutter is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Marvin W. Masters and Charles M. Love IV.
The case has been assigned to Circuit Judge Tod L. Kaufman.
