Woman sues Little General for injuries

CHARLESTON -- A woman is suing Little General Store after she sustained injuries on its premises.

On April 8, 2010, Cassandra Woods went to the Little General Store to purchase gasoline for her vehicle and was attempting to walk into the store to make other purchases when she tripped and fell on a metal strip that had separated from the concrete island where the gas pumps were located, according to a complaint filed Aug. 16 in Kanawha Circuit Court.

Woods claims the defendant had a duty to prevent and lookout for unsafe or potentially unsafe conditions and to maintain the store and the parking lot area in a reasonably safe condition.

The defendant knew or should have known of the unsafe condition in the parking lot area and failed to remedy or warn of the condition, according to the suit.

Woods claims the defendant destroyed the area and replaced the concrete island around the gasoline pumps after she fell, despite the fact that the defendant knew or should have known she was injured and that there was the potential for a claim to be filed against them.

The defendant destroyed evidence of the unsafe condition and is liable for a spoilation of evidence, according to the suit.

Woods is seeking compensatory damages with pre- and post-judgment interest. She is being represented by William M. Tiano.

The case has been assigned to Circuit Judge Carrie Webster.
