HUNTINGTON -- A Huntington man is suing Long John Silver's after he fell on its premises.
Performance Food Corp. was also named as a defendant in the suit.
On Aug. 18, 2009, Danny Ray Gorrell slipped and fell due to an unknown substance on the floor of the defendants' premises, according to a complaint filed Aug. 18 in Cabell Circuit Court.
Gorrell claims the defendants knew or should have known of the dangerous condition on the floor.
The defendants were negligent in not providing a safe environment for Gorrell and caused him to sustain physical and mental pain and suffering, according to the suit.
Gorrell is seeking compensatory damages with pre- and post-judgment interest. He is being represented by J. Roger Smith II.
The case has been assigned to Circuit Judge F. Jane Hustead.
