Former student sues Kanawha school board, baseball coaches for injuries

CHARLESTON -- A former Capital High School student athlete is suing the Kanawha County Board of Education and the school's two baseball coaches after he was injured during practice.

On March 13, Dillon King was required to attend baseball practice, but instead of practicing, the coaches occupied the boys' time by requiring them to pay "wiffle" baseball in the school gymnasium, according to a complaint filed Aug. 29 in Kanawha Circuit Court.

King claims the defendants were required to properly and adequately supervise the students during baseball practice, but that Robert Massey and Chas Hawkins did not do so.

During the wiffle baseball game in the school gymnasium, King was hit by another player in the mouth and was injured, according to the suit.

King claims after he was injured, no medical treatment was sought and Massey arranged for another student--who had no driver's license--to drive King home.

As a result of the defendants' negligence, King suffered a broken jaw and split gums that required surgery, according to the suit.

King claims the defendants caused his injuries by not adequately supervising the students during baseball practice.

King is seeking compensatory damages. He is being represented by Charles R. Webb.

The case has been assigned to Circuit Judge Jennifer Bailey.
