CHARLESTON -- A Kanawha County woman is suing Greentree Lending after she claims the defendant refused to pay disability benefits.
Stella Pullen made monthly payments to the defendant in the amount of $40.52 for life and disability insurance with the agreement that if she were to become disabled, the monthly payments on the loan would be paid by the defendant, according to a complaint filed Aug. 31 in Kanawha Circuit Court.
Pullen claims on April 21, 2004, she became disabled and on Dec. 26, 2007, she filed an application requesting that she receive the benefits promised to her by the defendant.
On Feb. 5, 2008, the defendant advised Pullen that she was not entitled to any benefits because her disability was not by reason of an accident, according to the suit.
Pullen claims when she purchased the disability insurance, she was never advised of any limitations on the disability insurance and had relied upon the representations of the defendant and for this reason, the benefits promised to her should be paid by the defendant.
The defendant has a duty to provide benefits to Pullen, according to the suit.
Pullen is seeking for the court to determine that she has the right to receive benefits under the loan agreement and for the court the enter an order enjoining the defendants from continuing to deny the benefits to which Pullen is entitled. She is being represented by Harold Albertson.
The case has been assigned to Circuit Judge James C. Stucky.
