HUNTINGTON -- A Cabell County couple is suing Steak 'n Shake after they claim injuries were sustained at its Barboursville location.

John Doe Corp., an unknown corporation, was also named as a defendant in the suit.

In September 2010, Sherman Saulton was a patron at Steak 'n Shake in Barboursville was was walking when he slipped on a broom left on the floor and was injured, according to a complaint filed Aug. 26 in Cabell Circuit Court.

Saulton claims the defendants had a duty to supervise employees and to safeguard its patrons and the general public to protect them from any harm and failed to do so.

The defendants were negligent in inspecting, maintaining and ensuring the general upkeep of its premises, according to the suit.

Saulton claims the defendants knew or should have known of the dangerous and defective condition and had a duty to warn of the condition and failed to do so.

The defendants also failed to inspect the store and failed to discover and remove and/or repair dangerous and defective conditions in the store, according to the suit.

Saulton and his wife, Linda Saulton, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by D. Adrian Hoosier II.

The case has been assigned to Circuit Judge David M. Pancake.
