Steel of W.Va. sues Pace American for failure to pay debts

HUNTINGTON -- Steel of West Virginia is suing Pace American Enterprises after it claims it has failed to pay more than $75,000 for steel products.

Between April 11 and June 23, Pace American Enterprises placed seven orders with SWVA for steel products and had them shipped to several different facilities, according to a complaint filed Sept. 7 in Cabell Circuit Court.

SWVA claims the defendant failed to pay for any of the products, which totaled in the amount of $76,111.59.

By not paying SWVA for the goods sold to the defendant within 30 days, Pace American Enterprises breached its contracts with SWVA and caused the plaintiff to suffer damages, according to the suit.

SWVA is seeking compensatory damages with pre- and post-judgment interest. It is being represented by Arnold J. Janicker.

The case has been assigned to Circuit Judge F. Jane Hustead.
