Colorado man sues 138 companies for mesothelioma

CHARLESTON -- A Colorado Springs man is suing 138 companies that he claims are responsible for his diagnosis of mesothelioma.

On March 24, Jerry Henderson was diagnosed with mesothelioma, according to a complaint filed Sept. 6 in Kanawha Circuit Court.

Henderson claims he never smoked and was exposed to asbestos during his employment career from 1954 until 1979.

The defendants caused Henderson to be exposed to asbestos and/or asbestos containing products during his career as a laborer and electrician, according to the suit.

Henderson claims the defendants knew or should have known of the dangers of asbestos.

The defendants are being sued based upon theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

Henderson is seeking a jury trial to resolve all issues involved. He is being represented by Victoria Antion, Scott A. McGee, Anne McGinness Kearse and Joseph D. McMullen.

The case has been assigned to a visiting judge.
