CHARLESTON -- A woman is suing the Kanawha Charleston Human Association after she was injured while volunteering at the animal shelter.
On May 30, Lisa L. Smith was volunteering at the defendant's animal shelter and was assisting in cleaning the kennels when she slipped and fell in soapy water that had accumulated near a drain located in the middle of an aisle, according to a complaint filed Sept. 2 in Kanawha Circuit Court.
Smith claims the kennel area near the drain was a hazardous condition not readily apparent and was present for a sufficient period of time to allow the defendant adequate and reasonable opportunity to remedy the condition.
The defendant failed to provide a reasonably safe area for volunteers and individuals to work, according to the suit.
Smith claims the defendant also failed to provide any warning of the hazardous condition.
The defendant' failure caused Smith to suffer a broken arm, surgery, loss of enjoyment of life, medical expenses and other damages, according to the suit.
Smith is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Scott H. Kaminski.
The case has been assigned to Circuit Judge Carrie Webster.
