Man sues Genesis for mother's death

WINFIELD – A man is suing Genesis Healthcare Corporation after he claims they are responsible for his mother's wrongful death.

590 North Poplar Fork Road Operations, LLC d/b/a Teays Valley Center was also named as a defendant in the suit.

From July 16, 2009, until Jan. 13, Mary Brafford was a nursing home resident of the defendants, according to a complaint filed Sept. 13 in Putnam Circuit Court.

David Brafford, Mary Brafford's son, claims the defendants failed to care for his mother during her time at the nursing home.

Mary Brafford suffered from multiple falls and sustained injuries, including a fractured left hip, according to the suit.

David Brafford claims the defendants failed to provide adequate and appropriate care and treatment, nursing services, physician services and other health care in an effort to enhance or maintain Mary Brafford's quality of life and medical condition.

The defendants' acts and omissions also violated Mary Brafford's right to be treated courteously, fairly and with the fullest measure of dignity, according to the suit.

David Brafford claims the defendants' actions caused Mary Brafford to suffer a fractured hip, physical injuries, mental anguish, physical pain and suffering and incurred medical treatment and expenses for treatment. He claims she was also deprived of adequate and appropriate treatment and healthcare or had such treatment and healthcare delayed and was denied her rights as a nursing home resident.

David Brafford is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge O.C. Spaulding.
