Woman says Spencer Gifts didn't pay final wages timely

CHARLESTON -- A former employee is suing Spencer Gifts for failing to pay her final wages within 72 hours of discharge.

Jessica Thompson was employed by Spencer Gifts from June 3, 2010 until March 26, according to a complaint filed Sept. 28 in Kanawha Circuit Court.

Thompson claims the defendant failed to pay her final wages within 72 hours of discharge, which violates the West Virginia Wage Payment and Collection Act.

The defendant's failure to pay Thompson's wages in a timely manner entitles Thompson to an award of wages and benefits due with interest, according to the suit.

Thompson is seeking judgment against the defendant for an amount equal to loss of all wages with interest and liquidated damages. She is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone III and G. Patrick Jacobs.

The case has been assigned to Circuit Judge James C. Stucky.
