CHARLESTON -- A Fayette County woman is suing All Med and Roscoe Medical after she claims they provided her with an incorrect and defective wheelchair.
Marian Coleman's physician prescribed her a lightweight K0004 type wheelchair, according to a complaint filed Sept. 30 in Kanawha Circuit Court.
Coleman claims the defendants provided her with the incorrect wheelchair, which was defective and unreasonably dangerous for use by her.
The defendants had a duty to provide Coleman with the type of wheelchair that was prescribed by her physician and to provide her with a wheelchair that would meet her special needs, according to the suit.
Coleman claims the defendants also had a duty to inspect the wheelchair and to make sure that it complied with the specifications of her treating physician.
The defendants were negligent in failing to inspect the wheelchair before delivery, according to the suit.
Coleman is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Marvin W. Masters and Kelly Elswick Hall.
The case has been assigned to Circuit Judge Charles E. King.
