CHARLESTON -- A Poca woman is suing Speedway after she sustained injuries on its premises.
On July 21, Marilyn Cook was walking on common property on the defendant's premises when she slipped on oil and fell, according to a complaint filed Oct. 3 in Kanawha Circuit Court.
Cook claims the defendant failed to properly clear the sidewalk in front of the convenient store of oil.
During the fall, Cook's glasses were "violently flung from her face, causing irreparable lens and frame damage to the eye wear," according to the suit.
Cook claims the defendant's failure to clear the spilt oil caused her to sustain bruising to her shoulder, knee and back; soreness in her shoulder, knee and back; post-traumatic pain in her shoulder, arm and wrist; anxiety; and other serious and severe personal injuries.
The defendant also caused Cook public embarrassment and severe emotional distress, according to the suit.
Cook is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Toby J. Buel Jr.
The case has been assigned to Circuit Judge Tod J. Kaufman.
