Woman sues Dynamic Construction for breach of contract

WINFIELD -- A Putnam County woman is suing Dynamic Construction after she claims the company breached its contract with her.

Diana Topeka owns property on Cow Creek Road in Putnam County and contracted the defendant to perform construction work and provide materials, supplies and equipment for the construction project on her home, according to a complaint filed Oct. 6 in Putnam Circuit Court.

Topeka claims the defendant failed to properly perform its contractual duties and obligations.

The defendant failed to properly install exterior and interior electrical wiring; properly install adequate ventilation and insulation systems; properly install windows and seal window openings; properly install a water barrier for the exterior wall; install the appropriate size drainage gutters; and properly construct the porches.

Topeka claims Dynamic Construction has forced her to hire other contractors to complete and correct the defendant's work.

The defendant's actions breached its contract with Topeka and caused her damages, according to the suit.

Topeka is seeking compensatory damages in excess of $200,000 with pre- and post-judgment interest. She is being represented by Johnson W. Gabhart and Jamie F. Little.

The case has been assigned to Circuit Judge O.C. Spaulding.
