CHARLESTON – A Kanawha County woman is suing AutoZone Stores, Inc., and an individual after she claims the individual ran over her ankle while she was at the store.
On July 23, 2010, Sarah Ennis and an AutoZone employee were examining her vehicle when Billy Joe Moore ran over her ankle, according to a complaint filed Oct. 11 in Kanawha Circuit Court.
Ennis claims Moore had a duty to drive his vehicle in a reasonable and prudent manner exercising due care for those other persons making use of the parking lot.
Moore also had a duty to obey the rules of the road and to maintain control of his vehicle so as to avoid collisions with people in the parking lot, according to the suit.
Ennis claims AutoZone had a duty to warn customers to move their vehicles to another safer less-travelled section of the parking lot that was or should have been reserved for examining vehicles for diagnostic purposes, or provide adequate warning to other drivers that she was in the parking lot examining her vehicle with an AutoZone employee.
As a result of the defendants' negligence, Ennis sustained injuries, according to the suit.
Ennis is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Scott H. Kaminski.
The case has been assigned to Circuit Judge Carrie Webster.
