Ripley woman names CAMC, doctor in malpractice suit

CHARLESTON -- A Ripley woman is suing Charleston Area Medical Center for being negligent during the birth of her son.

Dr. Devin Ciliberti was also named as a defendant in the suit.

On March 26, 2010, Cierra Daniel gave birth to Justin Trimble II at Charleston Area Medical Center, according to a complaint filed Oct. 18 in Kanawha Circuit Court.

Daniel claims the defendants negligently cared for Trimble by negligently failing to properly diagnose and/or determine his position prior to his delivery and negligently employing forceps and a vacuum during his delivery.

The defendants' actions were negligent, careless, reckless, wanton and with total disregard for the welfare of Trimble in the care and treatment provided to him, according to the suit.

Daniel claims her son suffered severe and irreversible deficit and damage.

The defendants failed to properly and timely provide critical medical care and treatment to Daniel and Trimble, according to the suit.

Daniel is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Richard D. Lindsay.

The case has been assigned to Circuit Judge Jennifer Bailey.
