Gubernatorial candidate sues Joe Holland Chevrolet for failing to repair vehicle

Moltis

CHARLESTON -- A man who ran for governor this year is suing Joe Holland Chevrolet after he claims he took his vehicle there for repairs and they did not repair it.

Arne Moltis brought his 2007 Nissan Titan for repair to the defendant after an accident, according to a complaint filed Oct. 12 in Kanawha Circuit Court.

Moltis claims when he came to pick up the vehicle after it was repaired, he was not told that there was no engine oil in the vehicle.

A few days later, on Oct. 3, the vehicle's Low Oil light and Check Engine light came on and Moltis took the vehicle to the Southridge Valvoline Instant Oil Change shop, according to the suit.

Moltis claims it was there that he discovered the vehicle had no oil and that the defendant had failed to put any oil into the engine.

Later, Moltis took the vehicle to Love Nissan in St. Albans, who found two leaks in the vehicle and replaced the engine oil cooler and two engine assemble valve covers, according to the suit.

Moltis claims the mechanic at Love Nissan informed him that he could not guarantee the vehicle would not have any more oil leaks because of the severity of the damage done to the vehicle because he had driven it without any oil.

The defendant was aware of the engine oil leak and failed to tell Moltis, according to the suit.

Moltis is seeking reimbursement for the damage done to his vehicle. He is representing himself.

The case has been assigned to Circuit Judge Tod J. Kaufman.

With 0.38% of the vote, he placed last in the May 14, 2011 Primary. Earl Ray Tomblin secured the Democratic nomination.
