HUNTINGTON -- A man is suing Rent-a-Car and the driver of a vehicle that caused a car accident and injured him.
On Oct. 23, 2009, Homer Gillispie was driving a 1993 Toyota pickup truck and was stopped due to traffic ahead of him on U.S. Route 60 when Michael D. Panik, while driving a 2009 Chevrolet Cobalt owned by Rent-a-Car, negligently crashed into the rear of his vehicle, causing Gillispie injuries, according to a complaint filed Oct. 21 in Cabell Circuit Court.
Gillispie claims at the time of the accident, Panik failed to maintain control of his vehicle.
Rent-a-Car was negligent in the care, upkeep and maintenance of the vehicle, according to the suit.
Gillispie claims the defendants are responsible for his injuries and caused him to suffer great pain of body and mind, physical injuries and impairments and loss of enjoyment of life.
Gillispie is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Michael S. Bailey.
The case has been assigned to Circuit Judge Paul T. Farrell.
