CHARLESTON -- A Yawkey couple is suing 28 companies responsible for a lung cancer diagnosis.
On Nov. 10, 2009, Denver Hall was diagnosed with lung cancer, according to a complaint filed Oct. 27 in Kanawha Circuit Court.
Hall claims during his employment with Pennzoil and Pennzenergy from 1974 until 1999, he was exposed to asbestos fibers.
The defendants failed to advise Hall of the dangerous characteristics of asbestos and asbestos-related products, according to the suit.
Hall claims the defendants also failed or omitted to provide him with the knowledge as to what would be reasonably safe and sufficient wearing apparel and proper protective equipment.
The defendants also failed and omitted to place any warnings or sufficient warnings on their containers of asbestos and asbestos materials to warn the handlers of its dangers, according to the suit.
Hall and his wife, Suzanna Hall, are seeking compensatory and punitive damages. They are being represented by Brian Alan Prim.
The case has been assigned to a visiting judge.
The 28 defendants named in the suit are Armstrong Pumps, Inc.; Baker Hughes, Inc.; Bucyrus International, Inc.; BW/IP International, Inc.; CBS Corporation; Champlain Cable Corporation; Crane Co.; Deere & Company, Inc.; Eaton Corporation; Flowserve U.S., Inc.; FMC Corporation; Gardner Denver, Inc.; Genuine Parts Company; Grinnell Corporation; Goulds Pumps, Inc.; Industrial Holdings Corporation; Ingersoll-Rand; ITT Corporation; Joy Technologies; McJunkin Red Man Corporation; Metropolitan Life Insurance Company; Navistar International Corporation; Pennzenergy; Pennzoil Company; Shell Oil Company; Shell Oil Products US; United States Steel Corporation; and Vimasco Corporation.
