CHARLESTON -- Future Generations Graduate School for Research and Applied Studies in Community Change, Inc., is suing TLTek after it claims it paid for 30 computers that were never delivered.
On June 13, the plaintiff and TLTek entered into a contract for the sale of 30 Dell laptop computers, wherein TLTek agreed to tender the laptop computers for the purchase price if $30,989.70, according to a complaint filed Oct. 26 in Kanawha Circuit Court.
The plaintiff claims the following day it made an advanced payment for the full purchase price.
On Aug. 23, the plaintiff contacted the defendant regarding the status of the anticipated delivery of the computers and on Sept. 13, TLTek promised to refund the money for the laptops, but failed to do so, according to the suit.
The plaintiff claims TLTek breached its contract.
During the course of the transaction between Future Generations and TLTek made material misrepresentations and false promises with regard to its intent to secure and deliver the goods for which Future Generations made advanced payments, according to the suit.
The plaintiff is seeking damages in the amount of $30,989.70 with interest. The school is being represented by Corey L. Palumbo and Evan R. Kime.
The case has been assigned to Circuit Judge Louis H. Bloom.
