CHARLESTON -- A Charleston woman is suing Diversified Maintenance Systems after she slipped on the floor at Sears and was injured.
John Sargent, the general manager of Sears Roebuck & Co., was also named as a defendant in the suit.
On Aug. 26, 2010, Dawn Locke was shopping in Sears when she slipped and fell on wet floor and was injured, according to a complaint filed Oct. 26 in Kanawha Circuit Court.
Locke claims the defendants had a duty to conduct its business of cleaning in a safe manner and to warn invitees who may be shopping or walking through the Sears department store of any unsafe condition.
The defendants' negligence caused Locke injuries, according to the suit.
Locke is seeking compensatory damages. She is being represented by Lia DiTrapano Fairless.
The case has been assigned to Circuit Judge James C. Stucky.
