CHARLESTON -- A former employee is suing Amedisys Holding for violationg the West Virginia Wage Payment and Collection Act.
Amedisys, Inc. and Amedisys West Virginia were also named as defendants in the suit.
Karen E. Neal was employed by the defendants from October 2003 until August 2010, according to a complaint filed Oct. 27 in Kanawha Circuit Court.
Neal claims during her employment deductions were made from her wages and she was not reimbursed for all hours she actually worked.
Despite her efforts to resolve the issues regarding timely payment of all wages due, Neal was unable to resolve the issues and when she resigned from her employment, she had substantial amounts of wages due and owing to her, according to the suit.
Neal claims failure to pay all wages due is a violation of the West Virginia Wage Payment and Collection Act.
The defendant violated the West Virginia Wage Payment and Collection Act by failing to pay all wages due by the next regular pay day after Neal's resignation, according to the suit.
Neal is seeking civil penalties and compensatory damages. She is being represented by Walt Auvil.
The case has been assigned to Circuit Judge Louis H. Bloom.
