Pedestrian struck by vehicle sues driver

HUNTINGTON -- A Culloden man is suing a woman who struck him with a vehicle.

On Oct. 29, 2010, Michael Allen Rigney was a pedestrian standing at the intersection of Pine Haven Drive and U.S. Route 60 in Huntington when Dakota Joe Mohr struck him with her vehicle, according to a complaint filed Nov. 2 in Cabell Circuit Court.

Rigney claims Mohr was operating her vehicle in a careless, reckless, negligent, willful, wanton, malicious and unlawful manner when she struck him with the vehicle.

Mohr failed to maintain proper control of her vehicle and failed to apply the brakes of the vehicle and was operating the vehicle at an excessive rate of speed, according to the suit.

Rigney is seeking compensatory damages. He is being represented by Paul E. Biser.

The case has been assigned to Circuit Judge F. Jane Hustead.
