HUNTINGTON -- A Huntington man is suing his neighbor for business operations violation.
Every day starting at 6 a.m., buses make turns on Stephen M. Nichols' property, which is less than 15 feet away from Slav N. Gratchev's home and beside the master bedroom, according to a complaint filed Nov. 2 in Cabell Circuit Court.
Gratchev claims the buses make terrible noises and have bright lights, which wake up his entire family, including his four-year-old daughter and infant son.
As a result, Gratchev's family does not get enough sleep and feel tired throughout the day, according to the suit.
Gratchev claims despite two lengthy conversations with the defendant, Nichols still allows the buses to turn around on his property.
Nichols advised Gratchev that if the buses bothered him, then he could sell his house, according to the suit.
Gratchev claims the defendant's actions violate Cabell County business operation laws.
The defendant's actions also violate Gratchev's right for peaceful and quiet living, according to the suit.
Gratchev is seeking compensatory damages and for the defendant to prohibit lending his property to be used by the buses. He is representing himself.
The case has been assigned to Circuit Judge David M. Pancake.
