Former employee sues Green Leaf for discrimination

CHARLESTON -- A former employee is suing Green Leaf Services of Beckley after he claims he was discriminated against because of his race.

Robert Brown was employed by Green Leaf Services of Beckley, which is a contractor that provides labor to various mine sites, according to a complaint filed Oct. 31 in Kanawha Circuit Court.

Brown claims on Feb. 27, he was sitting in a rail tub at Speed Mine when another African-American employee named J.J. Cox walked over to him.

Upon seeing them together, a Speed Mine employee named Dustin Adkins immediately remarked on their race and called them a racial slur, according to the suit.

Brown claims after complaining to the president of the defendant, he was supposed to be moved to another mine, but the defendant failed to do so.

The defendant terminated Brown's employment because he complained about being discriminated against, according to the suit.

Brown is seeking compensatory and punitive damages. He is being represented by Roger D. Forman and Daniel T. Lattanzi.

The case has been assigned to Circuit Judge Jennifer Bailey.
