Putnam couple sues Creative Kitchens for breach, negligence

WINFIELD -- A Putnam County couple is suing Creative Kitchens after they received damaged and defective cabinets for their kitchen.

Showplace Wood Products, Inc., the company that manufactured the cabinets, was also named as a defendant in the suit.

On Jan. 21, 2010, Clifton Dedrickson and Margaret Dedrickson purchased cabinets from Creative Kitchens for the purchase price of $18,177.06, according to a complaint filed Nov. 4 in Putnam Circuit Court.

The Dedricksons claim when Creative Kitchens was installing the cabinets, the couple observed that many of the cabinets were damaged or defective, including warps, scratches, chattering, incorrectly sized parts, mismatched finishes, uncovered nail holes and faulty glides.

On June 28, 2010, the Dedricksons notified Creative Kitchens of their dissatisfaction with the defective and/or damaged cabinets and offered to accept the defective and damaged cabinets at a discounted price of $12,177.06 or removal of the cabinets and a refund of the purchase price plus $4,000 for annoyance and inconvenience, according to the suit.

The Dedricksons claim Creative Kitchen finally removed the cabinets on Sept. 15, 2010.

On Nov. 10, 2010, Creative Kitchens tendered a check to the Dedricksons for the purchase price of cabinets, but also demanded the couple execute a full release and settlement agreement, according to the suit.

The Dedricksons rejected the settlement offer and returned the check, claiming they wanted the purchase price plus $4,000 for loss of use and enjoyment of the kitchen and inconvenience and annoyance.

The defendants breached their warranties and caused the Dedricksons to suffer harm, according to the suit.

The Dedricksons are seeking damages for loss of use and enjoyment of their kitchen in the amount of $10,000 with pre- and post-judgment interest. They are being represented by Donald L. Stennett and Joseph K. Merical.

The case has been assigned to Circuit Judge O.C. Spaulding.
