WINFIELD -- A former employee is suing Modular Building Consultants of West Virginia after he claims the company failed to pay his final wages within 72 hours of discharge.
Gary L. Adkins was employed by the defendant from August 2008 until May 3, according to a complaint filed Nov. 3 in Putnam Circuit Court.
Adkins claims even though his employment was terminated on May 3, he did not receive his final wages until May 10.
The defendant's failure to pay Adkins' final wages within 72 hours of discharge is in violation of the West Virginia Wage Payment and Collection Act, according to the suit.
Adkins claims because they defendant violated the West Virginia Wage Payment and Collection Act, he is entitled to treble damages.
Adkins is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge O.C. Spaulding.
