CHARLESTON -- A Charleston man is suing Rite Aid of West Virginia after he slipped and fell on snow and ice and was injured.
On Dec. 17, 2010, Joseph T. Dawkins was a business invitee at Rite Aid's Charleston location when he was walking through the store and slipped on snow and melted ice, according to a complaint filed Oct. 31 in Kanawha Circuit Court.
Dawkins claims the defendant had a duty to warn business invitees regarding any known unsafe conditions that might reasonably have been foreseen.
The defendant exposed Dawkins to an inherently dangerous condition on its premises and failed to have any warning signs nearby, according to the suit.
Dawkins claims as a result of the defendant's negligence, he sustained injuries and loss of enjoyment of life.
The defendant caused Dawkins to sustain pain and suffering; medical expenses; and lost wages, according to the suit.
Dawkins is seeking compensatory damages. He is being represented by Lia DiTrapano Fairless.
The case has been assigned to Circuit Judge Louis H. Bloom.
