Nick and Jill Pirillo vs. PNC Mortgage Corporation

* The Pirillos contacted PNC bank to ask about lowering their loan's interest rate. They were informed by PNC they would be eligible for a loan modification if they fell three months behind in their mortgage payments, and PNC told them to stop making their mortgage payments. Shortly thereafter, PNC started foreclosure on their loan. After two years, the Pirillo's and PNC entered into a loan modification. As part of the modification, PNC charged attorney fees of $1471.66 which is prohibited by West Virginia Consumer Credit and Protection Act. The Pirillo's seek class certification on all counts, with an award to all class members including civil penalties, damages, compensatory damages, interest, costs and attorney fees; a declaration that PNC breached the parties' contract, a single civil penalty of $4600, cancellation or a refund of the attorney fees of $1471.66, costs, pre and post judgment interest.
