WAYNE -- A Wayne County couple is suing West Virginia-American Water Company for injuries sustained because of a misplaced water meter lid.
On Oct. 14, 2010, Roger Price was walking on his property when he tripped and fell due to a misplaced water meter lid, according to a complaint filed Sept. 30 in Wayne Circuit Court.
Price and his wife, Janet Price, claim the defendant had a duty to supervise the actions and conduct of its agents, servants, employees, representatives and/or assigns and to safeguard the general public to protect them from any harm caused by them.
The defendant had an obligation to properly maintain the meter lid and failed to do so, according to the suit.
The Prices claim the defendant failed to inspect the premises and failed to provide reasonable and adequate maintenance to the premises.
The defendant also failed to warn the couple of any hazards and/or dangerous and defective conditions of the meter and surrounding area, according to the suit.
The Prices are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Kenneth P. Hicks.
The case has been assigned to Circuit Judge James H. Young Jr.
