HUNTINGTON -- A Barboursville man is suing the First State Bank for charging him unfair late fees on at least 29 occasions.
On Dec. 19, 2008, Paul Staley and his wife entered into a mortgage loan with the defendant, according to a complaint filed Oct. 17 in Cabell Circuit Court.
Staley claims although the promissory note said late fees would be no more than $15, he was charged late fees of $60.14 per month at least 29 times.
The defendant charged late fees even during a number of months when Staley made a payment on time, according to the suit.
Staley is seeking actual damages and civil penalties of $4,400 for each violation. He is being represented by Daniel F. Hedges.
The case has been assigned to Circuit Judge F. Jane Hustead.
