Woman sues HCR Manor Care for mother's death

CHARLESTON -- A woman is suing HCR Manor Care after she claims it is responsible for her mother's death.

Health Care and Retirement Corporation of America; and Danny Davis were also named as defendants in the suit.

On Oct. 14, 2005, Charlotte Kourey was admitted to Heartland of Charleston, where she remained until her death on June 5, 2010, according to a complaint filed Nov. 15 in Kanawha Circuit Court.

Nancy Cupit claims during her residency, Kourey suffered serious injuries from a pattern of poor care, neglect and abuse.

The defendants failed to appropriately implement a plane of care to prevent falls,; failed to provide adequate supervision and failed to provide assistance devices, according to the suit.

Cupit claims the defendants' negligence and abuse of her mother caused significant destruction of her physical and mental condition and led to her death on June 5, 2010.

The defendants also failed to keep Kourey and her family members fully informed of Kourey's total health status and of her medical condition during her residency, according to the suit.

Cupit is seeking compensatory and punitive damages. She is being represented by Andrew L. Paternostro, Sprague W. Hazard and Jeff D. Stewart.

The case has been assigned to Circuit Judge Louis H. Bloom.
