Man says former employer didn't pay final wages timely

CHARLESTON -- A former employee is suing Mission Information Resources is suing for failure to pay his final wages on time.

Alexander R. Hult was employed by the defendant from September 2009 until Aug. 31, according to a complaint filed Nov. 15 in Kanawha Circuit Court.

Hult claims on Aug. 1 he gave the defendant notice that Aug. 31 would be his final day of employment.

The defendant failed to pay Hult's final wages at the time of his resignation, as required by the West Virginia Wage Payment and Collection Act, according to the suit.

Hult claims the defendant's failure to pay his final wages on time entitles him to treble damages.

The defendant's violations also caused Hult damages, including indignity, embarrassment, humiliation and emotional distress, according to the suit.

Hult is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.

The case has been assigned to Circuit Judge Louis H. Bloom.
