CHARLESTON -- A former employee is suing Associated Behavioral Consultants after she claims it failed to pay her final wages in a timely manner.
Trina M. Ratliff worked for the defendant from May 2010 until Dec. 30, 2010, according to a complaint filed Nov. 16 in Kanawha Circuit Court.
Ratliff claims on Dec. 15, 2010, she gave the defendant notice that she would be resigning her employment on Dec. 30, 2010.
Associated Behavioral Consultants failed to pay Ratliff her final wages in full at the time of her resignation, as required by the West Virginia Wage Payment and Collection Act, according to the suit.
Ratliff claims the defendant's violation entitles her to treble damages.
The defendant's violation also caused Ratliff indignity, embarrassment, humiliation and emotional distress, according to the suit.
Ratliff is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Charles E. King.
