Couple sues BMW for defective vehicle

CHARLESTON -- A Kanawha County couple is suing BMW of North America fr selling them a defective vehicle.

On Nov. 16, 2010, Aaron Diehl and Heather Diehl purchased a 2007 BMW 750 LI from Bobby Rahal Automotive Group in the amount of $37,777, according to a complaint filed Nov. 14 in Kanawha Circuit Court.

The Diehls claim they experienced repeated non-conformities with the vehicle, which substantially impaired the use and market value of the vehicle and caused them to fear for their safety when operating the vehicle.

After a reasonable number of attempts, the manufacturer did not conform the vehicle to the warranty, nor replace the vehicle with a comparable vehicle which did conform to the warranties, according to the suit.

The Diehls are seeking revocation of acceptance of the vehicle; refund of the purchase price of the vehicle; and compensatory damages. They are being represented by Michael L. Glasser.

The case has been assigned to Circuit Judge Louis H. Bloom.
