Man sues Huntington night club for assault

HUNTINGTON -- A Huntington man is suing Rehab Industries after he was assaulted at its night club.

On Sept. 23, 2010, Jarred Maynard entered Rehab to meet with acquaintances there, according to a complaint filed Nov. 23 in Cabell Circuit Court.

Maynard claims while at the night club, he was served intoxicating beverages to the point where he could no longer defend himself and was severely beaten while on the property.

The defendant's owners or agents were aware that Maynard was consuming alcoholic beverages at their establishment even though he was under the legal drinking age of 21, according to the suit.

Maynard claims the defendant is liable for the incident because he was underage and they negligently served him alcohol and allowed him to become intoxicated.

The defendant's negligence, Maynard was injured in and about his body and extremities; suffered aggravation and inconveniences; suffered extreme pain; suffered physical disability; has lost income; incurred medical expenses from the injuries; and has suffered loss of enjoyment of life, according to the suit.

Maynard is seeking compensatory and punitive damages. He is being represented by Donald R. Jarrell.

The case has been assigned to Circuit Judge David M. Pancake.
