CHARLESTON -- A Kanawha County man is suing General Motors after he claims the vehicle he purchased was defective.
On Aug. 23, 2008, Scott Harrison purchased a new 2008 Chevrolet Silverado 1500 for the amount of $30,292, according to a complaint filed Nov. 18 in Kanawha Circuit Court.
Harrison claims after the purchase of the new motor vehicle, he began to experience repeated non-conformities with the new motor vehicle, which substantially impairs the use and market value of the subject motor vehicle and reasonably caused him to fear for his safety when operating the vehicle.
After a reasonable number of attempts, the manufacturer did not conform the new motor vehicle to the warranty, nor replace the vehicle with a comparable new motor vehicle, which did conform to the warranties, according to the suit.
Harrison claims as a result of the defendant's failure to conform the vehicle to the warranties after a reasonable number of attempts, he was damaged by the loss of use of the vehicle and has suffered annoyance, inconvenience and incurred expenses for alternative transportation.
The defendant has repeatedly violated its obligations under West Virginia Code, according to the suit.
Harrison is seeking revocation of acceptance and refund of the purchase price of the vehicle and compensatory damages. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
