Woman sues after falling in cemetery parking lot

CHARLESTON -- A Kanawha County woman is suing S.E. Cemeteries of West Virginia Inc. after she claims she was injured when she fell over an obstruction in the parking lot.

LOI Charleston, Inc., which is doing business as Tyler Mountain Funeral Home, was also named as a defendant in the suit.

S.E. Cemeteries of West Virginia is doing business as Tyler Mountain Memory Gardens.

On Dec. 3, 2009, Lillian A. Crawford was a non-trespassing entrant at Tyler Mountain Memory Gardens, which is owned and/or operated by the defendants, according to a complaint filed Nov. 28 in Kanawha Circuit Court.

Crawford claims while on the defendants' property, she was unable to see and fell over an obstruction in the parking lot.

The defendants were negligent and careless and breached their duty to keep their premises safe, according to the suit.

Crawford claims the defendants' conduct caused her mental anguish and distress; pain and suffering; medical expenses; aggravation, annoyance and inconvenience; and loss of enjoyment of life.

The defendants were under a duty to keep their premises safe and failed to do so, according to the suit.

Crawford is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Thomas H. Peyton.

The case has been assigned to Circuit Judge Carrie Webster.
