CHARLESTON -- A man is suing General Motors for a defective vehicle he purchased from Thornhill Superstore.
On Sept. 2, 2008, Kennis McCoy purchased a new 2008 Chevrolet Truck K1500 for the purchase price of $29,347.18, according to a complaint filed Nov. 18 in Kanawha Circuit Court.
McCoy claims after purchasing the vehicle, he experienced repeated non-conformities with the vehicle, which substantially impaired the use and market value of the vehicle and caused him to fear for his safety when operating it.
After a reasonable number of attempts, the manufacturer did not conform the vehicle to the warranty, nor replace the vehicle with a comparable new vehicle which did conform to the warranties, according to the suit.
McCoy claims as a result of the defendant's failure to conform the vehicle to its warranties, which caused him damage.
The defendant's actions also caused McCoy to suffer annoyance, inconvenience and incurred expenses for alternative transportation, according to the suit.
McCoy is seeking revocation of acceptance and refund of the purchase price of the vehicle and compensatory damages. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
