CHARLESTON -- A former employee is suing Bob Evans Farms after he claims he was wrongfully terminated from his employment because of his age.

Terry W. Ragalyi was also named as a defendant in the suit.

Kelvin Dean Cook was employed by Bob Evans Farms from July 1, 1986, until March 13, according to a complaint filed Nov. 29 in Kanawha Circuit Court.

Cook claims his employment was terminated in violation of the West Virginia Human Rights Act.

The defendants' violations of the West Virginia Human Rights Act entitles Cook to back pay and an award for emotional distress, embarrassment and mental anguish, according to the suit.

Cook claims Ragalyi was involved in the decision to terminate his employment, by either making the decision or by recommending his termination.

Cook is seeking compensatory and punitive damages and reinstatement to his former employment. He is being represented by J. Michael Ranson, Cynthia M. Ranson, George B. Morrone and G. Patrick Jacobs.

The case has been assigned to Circuit Judge Charles E. King.
