Monongalia couple says contractor didn't make proper repairs

MORGANTOWN -- A Monongalia County couple is suing McCloy Construction for failing to properly make repairs on their residence.

Bluerock Engineering, Inc. was also named as a defendant in the suit.

On June 18, 2008, McCloy Construction completed foundation repairs to the residence of Sam Sellero and Cathy Sellero, which was then owned by Susan Fair, according to a complaint filed Nov. 28 in Monongalia Circuit Court.

The Selleros claim Bluerock Engineering was hired by Fair on May 12, 2010, to make a structural evaluation of the repaired basement wall and two days later, certified that the foundation repair completed by McCloy was adequate.

After the basement wall was reinforced, an interior wall was framed that concealed the repaired basement wall from view and on Nov. 16, 2010, Fair sold the house to the Selleros, without them seeing the repaired condition of the wall, according to the suit.

The Selleros claim the wall is currently bowed 12 inches and is eight inches out of plumb and continues to move inward.

The defendants had a legal duty to properly perform the work that they performed on the residence and failed to do so, according to the suit.

The Selleros are seeking compensatory damages in the amount of $200,000. They are being represented by David M. Jecklin and Gary S. Wigal.
